1. General
“Indochinas.com” means the domain name used under license by One World Trading-Service-Tourism Co., ltd, based in Ho Chi Minh city, Vietnam. Indochinas.com acts as booking agent for the hotels and other service providers advertised on the website www.indochinas.com (the “Site”).
These terms and conditions are the agreement between whoever shall use this site and One World Trading-Service-Tourism Co.ltd services. These terms and conditions set out the rights and obligations of all users and those of Indochinas.com in relation to the services offered by this website. Any person, agent, or company that directly or indirectly pays One World for services, in this Agreement is called “Traveler(s)”.

References to “accommodation providers” means the owner/providers of the hotels, apartments, villas and other accommodation of any description featured on this website and “accommodation” means the accommodation including all facilities and services advertised on the Site that Indochinas.com has agreed to arrange in connection with your confirmed booking.
Affiliates are third parties who, in agreement with Indochinas.com, distribute Indochinas.com hotel rooms to their customers.
2. Important Information
Indochinas.com acts as a booking agent only in respect of all bookings Indochinas.com makes on your behalf. Indochinas.com undertakes no responsibility for, and are not liable for, the misrepresentations, breaches of contract, breaches of statutory duty or negligence of any of the accommodation providers and other suppliers of services who sell their products and services through us. This means that in the event of you suffering personal injury, illness or death as a result of any act or omission of an accommodation provider or other supplier of services (or their employees or agents) or you having any complaint about the quality of the services provided or having any other complaint at all, your sole right of redress will be against the independent third party who provided such service and Indochinas.com will be under no liability at all (whether in contract, tort or otherwise howsoever).
You accept that Indochinas.com has not in any way selected or assembled your travel arrangements for you. Your accommodation arrangements are not a package and do not fall within the meaning of The Package Travel, Package Holidays and Package Tours.
By proceeding to book accommodation and/or other services through the Site, you accept that you will be entering into a contract with the accommodation provider on their standard terms and conditions. If they are provided, Indochinas.com will endeavor (but undertake no liability to do so) to make copies of the accommodation provider’s terms and conditions available to you.
You understand that Indochinas.com may not have conducted any quality or other checks on the accommodation providers and Indochinas.com makes no representations about the suitability of the accommodation and/or services offered for sale through the Site. The inclusion or offering for sale of an accommodation and/or services by Indochinas.com does not constitute an express or implied endorsement or recommendation by Indochinas.com of such accommodation or services. Indochinas.com does not guarantee the accuracy of, and disclaim liability for any inaccuracies relating to, the accommodation and services offered for sale through us.
Nothing in these terms of use shall operate to exclude or limit the liability of Indochinas.com for fraudulent misrepresentation or death or personal injury caused by our negligence.
Where you, or any of the people that you are booking on behalf of, are in breach of any of the provisions of these Terms or contravention of any laws or rights of a third party, Indochinas.com reserves the right to cancel your booking without refund or compensation in any way and recover from you any costs incurred as a result of your behavior.
3. Site content, documentation and booking information.
Indochinas.com may modify the content of the Site and/or Terms at any time, and such modification shall be effective immediately upon posting of the modified content and/or Terms on the Site and your continued use of or access to this website will be deemed to indicate your acceptance of the modified content and/or Terms.
Any information placed on the Site relating to hotels advertised on the Site including, but without limitation, details of the hotel, the availability of rooms at the hotel, the price of the rooms, the facilities available at the hotel, any accreditations afforded to the hotel and/or any details relating to any other services advertised on the Site have been placed on the Site by accommodation and/or service providers who are independent businesses and are not agents or employees of Indochinas.com or its affiliates. Such information does not constitute any advice or recommendation given by Indochinas.com and Indochinas.com shall not be held liable for inaccuracies or errors in the accommodation contents or any of its elements. These independent businesses provide the services in accordance with their own terms and conditions which may limit or exclude their liability to you. Indochinas.com and its affiliates are not liable for any acts, omissions, breaches or negligence of any such independent businesses or any damages or expenses resulting from the aforesaid. Indochinas.com and its affiliates are not liable for any refunds in the event of overbooking or force majeure or any other cause beyond their control.
As Indochinas.com acts only as a booking agent Indochinas.com will have no responsibility for any errors in any documentation except where those errors were made by Indochinas.com.
4. Confirmation
To confirm a booking, you must be authorized to make the booking by all persons named on the booking and their parent or guardian for all party members who are under 18 when the booking is made. By making the booking, you are confirming that all persons named on the booking accept the Terms and that you will inform the other persons named on the booking of the confirmation details and any other appropriate information. By making the booking you also become responsible for making all payments due under the booking.
Indochinas.com will confirm your booking and issue you with an email confirmation. Indochinas.com will not deduct any money from your credit card or T/T (bank wire transfer). The accommodation or other service provider with which you enter into a contract will take payment.
In the event that you call Indochinas.com by telephone, or are called by Indochinas.com regarding your booking, calls may be recorded for monitoring and training purposes. In the event of a dispute regarding a booking, Indochinas.com reserves the right to review any call information.
5. If you cancel, amend or change a booking
You may modify or cancel your booking at any time prior to your arrival date through the Site.
If you cancel or amend your booking, there may be a cancellation charge or amendment fee levied by the accommodation or other service provider. In any event, if you fail to cancel or amend your booking in accordance with the provider’s cancellation or amendment policy, you will be charged a cancellation or amendment fee by the accommodation or other service provider. Further details of cancellation policy are set out in Indochinas.com email to you confirming your booking and are also shown on the hotel’s room details page prior to you making a booking.
If, for whatsoever reason, you do not turn up at the accommodation on the arrival date stated on your booking confirmation email, without prior warning to Indochinas.com (“a no show”), this shall be considered a cancellation.
6. Age and responsibility
You warrant that you are 18 years of age or over and have legal capacity to use the Site and to create a legally binding contract.
You warrant that all personal information submitted during accommodation booking is correct and you accept financial responsibility for all transactions made under your name or account.
You hereby authorize Indochinas.com to process all Personal Information about you and the persons named on the booking that has been obtained in connection with your booking. Personal information shall be deemed to include, but not be limited to: any telephone numbers, fax numbers, email addresses, addresses of residences, signatures, ID or passport copies, or any other information belonging to you or your group.
7. Cots(UK) / Cribs (US)
Please advise at the time of booking if you require a cot or crib, in order to give this information to the accommodation provider; however, Indochinas.com cannot guarantee this request will be met. Such request will be subject to availability and if the accommodation is unable to meet any such request, neither Indochinas.com, nor the accommodation, will have any liability to you in this respect. This request may only be available at an additional cost unless otherwise expressly stated in the description of the accommodation provider, and if any additional cost is applicable this should be paid by you direct to the accommodation provider.
8. Before you travel
Indochinas.com is not liable for damages or losses that may result from travel to any particular destination. The Government of your country may help travelers stay safe overseas. Check with your government for the latest advice on conditions and general information concerning specific countries.
It is your responsibility to ensure you has the relevant travel and health documents before departure for the country you are visiting, which shall include, but is not limited to, any inoculations that may be required, identification and passport. Indochinas.com shall not be liable for any expense incurred resulting from your missing, incomplete or incorrect documentation or any non-compliance with requirements.
9. Insurance
You are strongly advised to take out adequate travel insurance prior to arriving in your destination. It is your responsibility to check you have adequate insurance cover. The insurance should cover, amongst other things, the cost of cancellation by you, personal losses, all medical costs and the costs of assistance including return to the your country of residence in the event of an accident or illness.
10. Force Majeure
Indochinas.com will not be liable for any changes, cancellation, effect on your booking, loss or damage suffered by you or for any failure by the accommodation providers and/or Indochinas.com to perform or properly perform any of our respective obligations to you which is due to any event(s) or circumstance(s) if the non performance is caused by force majeure. By way of example force majeure includes, but is not limited to, war, revolution, terrorist act, closure of borders, epidemic, natural catastrophe or other causes that seriously affect both parties and other unforeseeable causes beyond our control.
11. Complaints or issues with your accommodation
In the unlikely event that you have reason to complain or experience any problems with your accommodation please inform the accommodation reception staff or management immediately, to enable them to take appropriate action.
12. Currency converter
Currency rates are based on various publicly available sources and are only updated daily; as such they cannot be guaranteed as completely accurate and should be used as guidelines only. Actual rates may vary and you may wish to verify these with a qualified professional.
13. Legislation and Courts of Jurisdiction
This agreement will be governed by Vietnam law and any disputes will be dealt with by the Ho Chi Minh City courts.
14. Indochinas.com privacy policy
Indochinas.com understands that making purchases online involves your trust and that you wish to remain in control of your personal information. Retaining your trust is a responsibility that Indochinas.com takes very seriously. By disclosing your Personal Information to Indochinas.com using this Site or over the telephone, you consent to the collection, storage and processing of your Personal Information by Indochinas.com as stated in this Privacy Policy.
Any changes to the Indochinas.com Privacy Policy will be made to this page. Your continued use of this Site will constitute your agreement to the changed Terms of using this Site.
“Personal Information” means information that relates to a living individual who can be identified from that information or from that information together with other information which is held by or is likely to be held by Indochinas.com.
When you browse the Site, Indochinas.com does not collect Personal Information about you. The only way Indochinas.com can collect any kind of personal information is if you give it to us.
15. Protection of Personal Data
The Personal Information that Indochinas.com collects from you shall be obtained, processed and transmitted in compliance with applicable data protection legislation. Since Indochinas.com servers are located in Thessaloniki, Greece the personal information that Indochinas.com collects from you shall be obtained, processed and transmitted in compliance with Greek laws.
Indochinas.com takes full responsibility for ensuring that proper security measures are in place to protect your information and store the information in secure databases at secure addresses to prevent unauthorized access. Indochinas.com must pass the information on to the relevant suppliers of your travel arrangements. The information may also be provided to security or credit checking companies, public authorities such as customs/immigration if required by them, or as required by law.
To ensure that your booking runs smoothly Indochinas.com needs to use information such as your name and address, credit card details, special needs, dietary requirements etc. Indochinas.com will apply appropriate security measures to protect this data. However, Indochinas.com may disclose information about you to other organizations that are hotel partners or affiliates or to organizations contracted by Indochinas.com to manage aspects of the Site. Additionally, controls on data protection in your destination may not be as strong as in the European Economic Area (EEA). Indochinas.com will not; however, pass any information onto any person not responsible for part of your travel arrangements. This applies to any sensitive information that you give to Indochinas.com such as details of any disabilities, or dietary/religious requirements. If Indochinas.com cannot pass this information to the relevant accommodation and/or service providers, Indochinas.com cannot provide your booking. In making this booking, you consent to this information being passed onto the relevant persons.
16. Use of Information
You hereby give express consent to allow the incorporation of any data provided to the files of existing personal data in Indochinas.com and to the treatment of such for the purpose of management, administration, mediation and contracting of the services offered by Indochinas.com, the management of the bookings and the collection of products and services through Indochinas.com, call centers; the management of incidences; statistics; commercial publicity and other promotions by means of electronic mail, SMS, MMS or any other similar mean, and the subscription to news bulletins.
You also give express consent to allow Indochinas.com to transmit your personal data for marketing purposes to selected Affiliates but only in cases where you have previously activated the option to “opt in” through the website, authorizing this transfer. In such cases, Indochinas.com shall only transfer to Indochinas.com Affiliates your adequate, relevant and not excessive personal data (name and email addresses) so you will be able to receive marketing material from Indochinas.com Affiliates related to the Affiliate’s or Indochinas.com’s products. In any case you have the right to revoke anytime this consent by getting in touch with Indochinas.com, and Indochinas.com will stop transmitting your information. The Affiliate will show their contact information in the marketing material and Indochinas.com has no control on the marketing material the Affiliate may send to you, therefore Indochinas.com disclaims any kind of liability that may arise from the marketing material from the Affiliate, being the Affiliate responsible for that.
Indochinas.com may use the Personal Information to contact you about important changes to the Site, new services and with details of other products and services offered by Indochinas.com or One World Trading-Service-Tourism Co.ltd. Where Indochinas.com collect such information, Indochinas.com makes clear the nature of the information and the purposes for which it is used. Indochinas.com do not knowingly collect Personal Information from children.
Indochinas.com does not automatically subscribe users to Indochinas.com newsletter. In order to receive the newsletter you must opt to subscribe and be informed by email of news and hotel offers. On the Booking form you are able to unselect an option to receive a newsletter from Indochinas.com when making your booking. If you would like to unsubscribe from Indochinas.com newsletter at any time, you can advise us via the unsubscribe option on each newsletter. Indochinas.com will use your personal information to invite you to leave a review following your stay.

If you should wish to exercise rights of access, rectification, cancellation or opposition granted by the PDPR, you should proceed as follows: You can find out what Personal Information Indochinas.com holds about you by writing to us. Indochinas.com will acknowledge your request within ten working days. Should Indochinas.com be prevented from disclosing your Personal Information Indochinas.com will give reasons for any such refusal. If any of the Personal Information that Indochinas.com hold about you is incorrect or needs to be updated, please contact Indochinas.com at the above address. Indochinas.com may request that you provide further information and identification to enable Indochinas.com to comply with this request.
17. Use of ‘cookies’
When you view the Site, Indochinas.com may store some information on your computer. You may only use this website to make legitimate enquiries or bookings for yourself or another person for whom you are legally authorized to act.

• make any other unauthorized, false or fraudulent booking;
• use any software, routine or device to interfere or attempt to interfere electronically or manually with the operation or functionality of this website including, but not limited to, uploading or making available files containing corrupt data or viruses via whatever means;
• deface, alter or interfere with the appearance and layout of this website or the underlying software code;
• take any action that imposes an unreasonable or disproportionately large load on this website or related infrastructure;
Without prejudice to any of Indochinas.com’s other rights, Indochinas.com reserves the right to deny access to this website and/or cancel bookings wherever and whenever Indochinas.com believes (at Indochinas.com absolute discretion) that you are in breach of any of the Indochinas.com Terms.
20. Links and downloads
Indochinas.com may provide hyperlinks or pointers to other websites maintained by third parties which Indochinas.com think may be of interest to visitors of the Site. Such other websites are not under the control of Indochinas.com or maintained by Indochinas.com and Indochinas.com is not responsible for the content of such websites. Indochinas.com provides these links for your convenience only but does not monitor or endorse the material on them. Indochinas.com cannot accept any liability whatsoever and howsoever arising in relation to any such other websites (including by way of example, any inability to access or delay in accessing any such other website) or in relation to any material or information appearing on them or which you may otherwise come across after leaving the Site by way of a hypertext link or any other means or for any services or facilities of any description which you may book through or via any such website.
It is always wise for you to run an anti-virus program on all content and materials downloaded from the Internet in general and the Site in particular.
21. Group bookings (5 rooms or more)
Travelers must complete the groups enquiry form. A member of the TS groups department will then contact the agent to discuss booking requirements/make the booking. The hotel has the right to apply certain conditions, which will be advised to the agent at the time of booking. Group bookings must not be split into smaller multiple bookings.
22. Special Requests
Special requests to hotels such as non smoking or adjoining rooms will be passed on but cannot always be confirmed or guaranteed. Disabled rooms usually have wheelchair access but MAY NOT include features for the seriously disabled. An email should be sent to booking@indochinas.com if a disabled room is required so that the hotel can be informed. Disabled rooms are on request and TS cannot be held responsible if an adapted room is not provided upon arrival.
23. Hotel Facilities
Travelers must acknowledge that the availability of the facilities and features listed for each hotel are under the direct control of the hotel and as such we cannot be held responsible if those facilities or features are not made available to the customer during the period of their stay. If a facility or feature is of particular importance to the customer, then the agent should check with us or the hotel that this facility or feature will be available during the dates of the customer’s stay. Please note that, in particular, swimming pools and air conditioning are only available seasonally and it is the traveler’s responsibility to check whether these facilities will be available during the customer’s stay.
24. Late Arrival
Travelers must ensure that we are informed in writing at least 24 hours prior to arrival of any Customer who is due to arrive at the hotel after 19h00. Failure to do so may result in problems at check-in.
25. Room Types
It is the agent’s responsibility when making a booking to ensure they have booked the correct room type for their customer. All details of the room types and the number of people that can be accommodated in the room are available on the search screen and should be double checked on your email confirmation. Room types available are as follows:-
Single Room – Contains one single bed. Suitable for one person.
Twin Room – Contains two single beds. Suitable for two people.
Double Room – Contains one double bed or two single beds made up as a double. Suitable for two people.
Triple Room – Contains (1 twin or double bed + 1 extra bed) or (2 double beds). Most hotels do not have one full size bed for each guest. Suitable for 3 people.
Quad Room – Please note that the room may not contain four single beds. Room may contain two double beds. Suitable for 4 people.
Child Bed – often a roll away bed, suitable for a child under the age of 18 years.
Cot cradle or crib – suitable for a child under the age of 2 years.
Shared Facilities – Bathroom and toilet facilities are not private en-suite. They are outside the room and are shared with other customers. In hostels, this description may include shared kitchen facilities too.
Please be aware that room type and size will vary from country to country.
26. Trade Fair / Special Condition Reservations
During trade fairs or festivals hotels MAY NOT honor our usual reduced rates which means that the price you pay may be higher than the hotel’s published rate. This can happen at any time when availability is scarce. Cancellation charges may vary to those laid down in the cancellation policy in accordance with terms laid down by our suppliers. Indochinas.com reserves the right to alter this charging structure in such circumstances.
27. Amendments
If you need to change the dates of travel, there may be other rates valid for the new dates requested. If the hotel cannot accommodate your requested amendment, the booking will automatically revert to its original status although Indochinas.com will always endeavor to offer a suitable alternative.
FIT Amendments
Travelers can amend bookings free of charge either online or by email.
Online – Certain amendments can be effected through the travelers’ account online. Where an amendment cannot be effected online, the traveler must email the indochinas.com customer service department for assistance on the address below.
Email – The travelers should contact us by e-mail at booking@indochinas.com. All amendment requests must be received in writing and are subject to availability.
Amendment Policy
Bookings amended 48 hours (GMT+ 7:00) or more prior to the day of arrival – no charges.
Bookings amended within 48 hours (GMT+ 7:00) or the day of arrival may be subject to charges from the hotel/supplier which will be passed onto the Agent.
However all bookings are subject always to clause 26 above.
28. Group Amendments
Travelers can amend group bookings by sending an email to booking@indochnas.com. All amendment requests must be received by us in writing. We will endeavor to amend bookings free of charge unless we incur a charge from the supplier. In this instance we will pass the charge onto the agent.
29. Cancellations
It is the traveler’s responsibility to ensure that all cancellation requests are correctly submitted to us. The travelers must also ensure they have received written confirmation from us that the booking has been cancelled.
Should the customer fail to arrive at the hotel on the first night of the booking, the whole booking may be cancelled and you will be charged 100% of the first night. Additional charges may be applied depending on the hotel and destination.
-FIT Bookings
Cancellations by the travelers
Travelers can cancel bookings online or by email.
Email – Whoever should contact us by email at booking@indochinas.com quoting the indochinas.com booking reference. We will email you with confirmation of the cancellation.
Cancellation Policy
Bookings cancelled 48 hours (GMT+ 7:00) or more prior to the day of arrival – no charges.
Bookings cancelled within 48 hours (GMT+ 7:00) or the day of arrival – 100% of the first night.
However all bookings are subject always to clause 26 above.
-Group Bookings
Cancellations by the travelers.
Cancellations must be made in writing to booking@indochinas.com.
We will advise travelers of cancellation provisions which apply at the time of booking.
-Cancellations by the accommodation provider.
In the unlikely event of a confirmed booking later becoming unavailable, the accommodation provider will abide by the following:
i. The accommodation provider will offer a suitable alternative in the same category or better within a similar location or a full refund.
ii. We will inform the agent in writing of any changes to bookings providing the accommodation provider has informed us.
iii. Usually, this will be done in advance of travel however where this is not possible, we will endeavor to ensure that the accommodation provider resolves the situation as efficiently as possible.
iv. It is the travelers’ responsibility to cancel any alternative if you or your customer does not approve of the hotel offered. Failure to cancel an alternative that is not acceptable will result in non-arrival charges. All cancellations must be made in writing to booking@indochinas.com 48hrs prior to arrival.
v. If the travelers encounters any problems whilst at the hotel the agent should abide by the indochnas.com complaints procedure documented in section 30 as below.
30. Complaints Procedure
In the unlikely event a customer is unsatisfied with their hotel; the travelers must ensure the following steps are adhered to:
-Travelers are instructed to discuss any issues directly with the hotel management.
-Should the hotel not resolve the travelers’ complaint, the travelers should contact us. Our team will endeavor to assist in order to rectify the situation.
-Should your customer still feel that the complaint has not been resolved, please forward your complaint in writing with full details of any actions you has already taken to booking@indochinas.com within 10 days of the customers return. Indochonas.com will abide by the following timescales:
i. an acknowledgement sent within three working days
ii. a progress update within 14 working days
iii. a substantive reply and conclusion within 28 working days
31. Liability
Traveler’s contract is with the accommodation provider. Indochinas.com acts only as agents. Given that we only act as agents for the hotel accommodation provider, we can accept no liability whatsoever for any death, personal injury, loss or damage of any kind to travelers, unless caused by our own negligence. In so far as we have any liability to you, then proceedings in respect of any such liability shall be governed by Vietnamese law and the exclusive jurisdiction of the Ho Chi Minh City Courts.
32. Law
All contractual obligations arising out of these terms and conditions shall be deemed to come into existence in the country of the Principal and be subject to the law and jurisdiction of the Courts of that country.
33. Changes to Terms and Conditions
Indochinas.com reserves the right to change or update these terms and conditions relating to the use of the site without prior notice to you. The latest version will always be available on the site and by using the site; you are accepting the latest version available.
34. Intellectual Property
The copyright, trademarks and other intellectual property rights in and relating to this site are reserved to www.indochinas.com. The content or data found on this site may not be reproduced, sold, transferred or modified without the prior written consent of us. TROUBLESHOOTING – PLEASE REMEMBER
VOUCHERS
It is your responsibility to check all vouchers are correct and to ensure that all clients present the voucher to the hotel at check in. This is crucial as the voucher contains information that the hotel will use to locate the booking and is proof of pre-payment.
CHECK IN
Please advise that should they experience any problems at check-in they should contact us straight away. Our Customer Service department will be on hand to assist and most issues can be resolved within minutes.
Please bear in mind that any complaints need to be received in writing to booking@indochinas.com within 10 working days of the customer’s return. Customer Services will then normally take between 15-28 days to deal with all queries.
NON-HOTEL RESERVATIONS
You can make Apartment, Private Transfer, Sightseeing and Conference reservations through us. Vouchers for these bookings will be emailed to you.
